Effective from: 19. 10. 2026
1.1. These terms and conditions govern the mutual rights and obligations arising from the sale of goods by the following trader:
Mgr. Martin Vala
Company ID: 73187232
Tax ID: CZ7604205004
registered office: U Tří lip 953, 739 44 Brušperk
e-mail: obchod@steamy.cz
telephone: +420 775 576 686
(hereinafter referred to as the “seller”).
Steamy.cz is the seller’s trade brand.
1.2. These terms and conditions apply on a supplementary basis to orders placed by e-mail or by another individual means, unless otherwise agreed between the seller and the buyer.
1.3. The buyer may be a consumer or a person purchasing in connection with their business activities or the exercise of their profession (hereinafter also referred to as a “business buyer” or “wholesale customer”). Provisions that apply exclusively to consumers under applicable legislation do not apply to business buyers.
1.4. Any differing provisions agreed between the seller and the buyer in a specific contract or order take precedence over these terms and conditions.
1.5. The seller may amend these terms and conditions. The version effective at the time a particular contract is concluded applies to that contract.
2.1. Depending on the options available in the online store, the buyer may purchase through a user account or without registration.
2.2. The buyer must provide correct and truthful information when registering and placing orders and update it as necessary whenever it changes.
2.3. The buyer must protect their user account login details against misuse.
2.4. Information about the goods, their characteristics and their current prices is provided in the online store. Before submitting an order, the buyer can check and correct the information entered, the contents of the shopping cart, the shipping method and the payment method.
2.5. The buyer submits the order using a button that clearly indicates the obligation to pay for the goods ordered.
2.6. After receiving the order, the seller sends an automatic order confirmation, including an order summary, to the buyer’s e-mail address. The purchase contract is concluded when the seller confirms receipt of the order.
2.7. In justified cases, particularly in view of the quantity of goods, their availability, price or the unusual nature of the order, the seller may ask the buyer for additional confirmation or clarification of the order.
2.8. The order and related information are stored in the seller’s system. Depending on the options available in the online store, the buyer can view their order details through their user account or after verification of the specific order.
2.9. The contract may be concluded in the language of the relevant language version of the online store.
2.10. For herbal blends, natural changes in moisture, particularly drying, may cause a change in weight between weighing during packaging and receipt by the buyer. This weight variation is limited to ±5 % of the net weight measured during packaging. This does not affect statutory requirements concerning the quantity of goods supplied or the buyer’s rights in respect of defective performance.
3.1. The price of the goods is stated for each product. Prices intended for consumers include VAT.
3.2. Shipping costs and any other costs associated with the specific delivery method selected may be added to the price of the goods. The amount of these costs is displayed to the buyer before the order is submitted.
3.3. Depending on the options currently available in the online store, an order may be paid for:
a) through an online payment gateway,
b) by bank transfer,
c) by cash on delivery, if available for the order in question.
Cash on delivery is offered only for delivery within the Czech Republic.
3.4. For advance non-cash payments, the goods are dispatched only after the seller has received payment.
3.5. When paying by bank transfer, the buyer must pay the purchase price within 7 days of the conclusion of the purchase contract. If the price is not paid within this period, the seller is entitled to withdraw from the purchase contract.
3.6. For cash on delivery, the purchase price is paid upon receipt of the shipment.
3.7. Cash payment is not possible for personal collection. The order must be paid for before collection.
3.8. The tax document may be sent to the buyer electronically at their e-mail address.
4.1. Available shipping methods and their prices are listed in the online store when placing an order. The seller primarily uses the services of PPL and Zásilkovna/Packeta. For certain international deliveries, the shipping method may be agreed individually.
4.2. If the buyer is a consumer and no specific delivery time has been agreed, the seller will deliver the goods without undue delay, no later than within the period prescribed by law.
4.3. The buyer may choose free personal collection of the order at:
Rudé Armády 627, 739 21 Paskov.
No shop with regular opening hours is operated at this address. The collection date and time must be agreed with the seller in advance.
4.4. The terms of any free shipping offer are stated in the online store. Free shipping does not apply to wholesale customers unless otherwise agreed individually.
4.5. The buyer must take delivery of the goods ordered. Failure to take delivery of a shipment does not in itself constitute withdrawal from the contract.
4.6. If a shipment is returned to the seller because the buyer failed to take delivery, the seller may request reimbursement of the costs reasonably incurred in connection with that failure. The shipment may be sent again by agreement with the buyer, and the seller may require advance payment of the costs of the new delivery.
4.7. If a shipment is lost or damaged during transport before it is handed over to the consumer, the seller will resolve the situation with the carrier. The buyer may report such a situation by e-mail to obchod@steamy.cz.
5.1. A consumer who has concluded a distance contract has the right to withdraw from the contract without giving any reason within 14 days of receiving the goods, unless the law excludes withdrawal in the case concerned. Withdrawal is also possible before receipt of the goods.
5.2. To exercise the right of withdrawal easily, the consumer may use the electronic “Return goods” function available through the order details on Steamy.cz. After the electronic withdrawal is submitted, the seller will confirm its receipt in text form.
5.3. The consumer may also withdraw from the contract by making any other unequivocal statement addressed to the seller.
5.4. To meet the deadline, it is sufficient for the consumer to send the withdrawal notice before the deadline expires.
5.5. Following withdrawal, the consumer must send or hand over the goods to the seller without undue delay, no later than within 14 days, at the following address:
Mgr. Martin Vala – Steamy.cz
Rudé Armády 627
739 21 Paskov
unless another return method has been agreed with the seller.
5.6. The consumer bears the direct costs of returning the goods following withdrawal from the contract.
5.7. The consumer is liable only for any diminished value of the goods resulting from handling them beyond what was necessary to establish their nature, characteristics and functioning. Any reduction in the amount refunded will correspond to the actual diminished value of the goods caused by such handling. The mere need to repackage the goods does not give rise to a separate claim for reimbursement of costs.
5.8. The seller will refund the payments received from the consumer, including delivery costs, without undue delay, no later than within 14 days of withdrawal from the contract. If the consumer chose a delivery method other than the least expensive method offered, the seller will refund delivery costs in the amount corresponding to the least expensive delivery method offered. Personal collection of goods is not considered a delivery method for this purpose. The seller will refund the money using the same method by which it was received from the consumer. Another refund method may be agreed with the consumer and must not result in any additional costs to the consumer. For an order paid for by cash on delivery, the funds may, by agreement with the consumer, be refunded to a bank account specified by the consumer.
5.9. The seller is not obliged to refund the payments before receiving the returned goods or before the consumer provides proof that the goods have been sent back, whichever occurs first.
6.1. The consumer cannot withdraw, in particular, from a contract for the supply of goods manufactured or modified to their individual requirements, or in other cases specified by law.
6.2. The consumer cannot withdraw from a contract for herbal blends, teas and other goods supplied in sealed packaging if the consumer has broken the seal and the goods are therefore unsuitable for return for health protection or hygiene reasons. This provision applies to products whose primary packaging is heat-sealed or fitted with an irreversible seal before first use.
6.3. An exception to the right of withdrawal does not affect the right to make a complaint about defective goods. Opening a product therefore does not in itself exclude a complaint concerning an actual defect.
7.1. The seller is liable to the consumer for ensuring that the goods are free from defects upon receipt and conform to the agreed description, quantity, quality, functionality and other characteristics that the buyer may reasonably expect in view of the nature of the product.
7.2. The consumer may notify the seller of a defect that becomes apparent in the goods within two years of receipt. If a defect becomes apparent within the first year of receipt, the goods are presumed to have been defective upon receipt, unless the nature of the goods or the defect rules this out.
7.3. If the goods are defective, the consumer may request that the defect be remedied by repair or by supplying a new item free from defects, subject to the statutory conditions and taking into account the nature of the defect and the proportionality of the chosen solution.
7.4. Subject to the conditions laid down by law, the consumer may request an appropriate reduction in the purchase price or withdraw from the contract, particularly if the seller does not remedy the defect, the defect appears repeatedly, the defect is substantial, or it is clear that it will not be remedied within a reasonable time or without significant inconvenience to the consumer.
7.5. A complaint may be submitted, in particular, by e-mail to obchod@steamy.cz. The buyer should provide information enabling the purchase to be traced, identification of the goods concerned, a description of the defect, contact details and the requested method of resolution. Presenting an invoice is not the only possible way to prove a purchase; it is sufficient if the purchase from the seller can be reliably verified by other means.
7.6. If the goods need to be physically handed over to the seller to assess the complaint, the seller will agree a suitable shipping method with the buyer. The seller may provide the buyer with a shipping label or a shipping code at the seller’s expense. The seller will take receipt of the goods for the purpose of remedying the defect at the seller’s own expense.
7.7. The address for physically sending goods subject to a complaint is:
Mgr. Martin Vala – Steamy.cz
Rudé Armády 627
739 21 Paskov
7.8. When a complaint is submitted, the seller will issue the consumer with written confirmation containing the information required by law. Once the complaint has been resolved, the seller will provide written confirmation of the method and date of resolution or, where applicable, written reasons for rejecting the complaint.
7.9. The consumer’s complaint, including remedying the defect, will be resolved without undue delay, and the consumer will be informed of its resolution no later than within 30 days of its submission, unless the seller and the consumer agree on a longer period. If this period expires without resolution, the consumer may withdraw from the contract or request an appropriate price reduction.
7.10. Where a complaint is justified, the consumer has the right to reimbursement of costs reasonably incurred in exercising rights in respect of defective performance, including reasonable costs of transporting the goods to the seller. If the complaint is accepted and repaired or replacement goods need to be sent to the consumer, the seller bears the costs of their delivery.
7.11. These rules apply to goods purchased directly from the seller. For a product purchased from another independent retailer, the consumer should primarily submit a statutory complaint to that retailer.
8.1. The provisions of these terms and conditions intended exclusively for consumers do not apply to a buyer acting in connection with their business activities or the independent exercise of their profession.
8.2. A wholesale customer purchases at the prices set by the seller for the price group to which the customer is assigned, unless a different price has been individually agreed.
8.3. A price stated by the buyer in their own ordering system, order or other document is not binding on the seller if it does not correspond to the seller’s current price for the relevant price group and has not been individually agreed.
8.4. Prices in currencies other than CZK are converted from prices in CZK using the current exchange rate of the Czech National Bank. As a result of exchange rate changes, prices in foreign currencies may change without any change to the base price of the goods in CZK.
8.5. The standard payment term for a wholesale customer’s invoice is 14 days, unless otherwise agreed.
8.6. The standard period for dispatching a wholesale order is no more than 14 days from its receipt, unless otherwise agreed. The seller usually dispatches goods in stock considerably earlier; however, this is not a contractually guaranteed period.
8.7. For orders from hospitals, healthcare facilities and other institutional customers, different payment terms, payment deadlines, invoicing requirements, delivery notes or other terms of a specific order may, in particular, be agreed individually.
8.8. Individually agreed terms of a specific order accepted by the seller take precedence over the general provisions of these terms and conditions.
8.9. The seller records orders received by e-mail in their system and confirms receipt to the buyer electronically. The terms and conditions applicable to the order may form part of this confirmation.
8.10. Wholesale customers always pay shipping costs, unless expressly agreed otherwise in a specific case.
9.1. The buyer may send questions, suggestions and complaints unrelated to defective goods by e-mail to obchod@steamy.cz.
9.2. The seller may communicate with the buyer by e-mail, telephone or another suitable means of communication, depending on the nature of the particular matter.
10.1. The seller provides information about the processing of personal data in a separate document entitled Privacy Policy.
10.2. The rules for using cookies and similar technologies are governed separately according to the technologies actually used and the settings of the online store.
11.1. If a dispute arising from a purchase contract occurs between the seller and the consumer and cannot be resolved by mutual agreement, the consumer may submit an application for out-of-court dispute resolution to the competent ADR entity.
11.2. The competent entity for this type of consumer dispute is:
Česká obchodní inspekce
Ústřední inspektorát – oddělení ADR
Gorazdova 1969/24
120 00 Praha 2
https://adr.coi.cz
12.1. Legal relationships arising from the purchase contract are governed by the law of the Czech Republic.
12.2. If the buyer is a consumer habitually resident in another country, the choice of Czech law does not deprive the consumer of the protection afforded by provisions of the law of their country that cannot be derogated from by agreement and that would otherwise apply under the relevant rules of private international law.
12.3. If any provision of these terms and conditions is invalid or ineffective, this does not affect the validity of the remaining provisions.
12.4. The current version of these terms and conditions is available on Steamy.cz. The version effective at the time the contract is concluded applies to that contract.
12.5. The seller’s contact details:
